THANK YOU FOR YOUR INTEREST IN BECOMING A SORTED HOUSE PROVIDER.  BY CLICKING ON THE “ACCEPT” BUTTON WITHIN OUR MOBILE SOFTWARE APPLICATION OR WEBSITE (SORTED HOUSE SOLUTION), COMPLETING THE SIGN-UP PROCESS TO BECOME A SORTED HOUSE PROVIDER OR CONTINUING TO KEEP YOUR DETAILS ON THE SORTED HOUSE PROVIDER DATABASE YOU ARE AGREEING TO THESE TERMS WHICH WILL BIND YOU. 

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT COMPLETE THE SORTED HOUSE PROVIDER REGISTRATION, DO NOT RESPOND TO ANY COMMUNICATION FROM US REGARDING POTENTIAL JOBS AND NOTIFY US IMMEDIATELY TO REMOVE YOUR DETAILS FROM THE SORTED HOUSE PROVIDER DATABASE.

These terms apply to people in the United Kingdom who wish to promote their products and/or services (Providers) to potential customers through the Sorted House Solution (Users).  If you are User, you need to agree to our User Agreement at www.sortedhouse.com

Please note, you must be 18 or over to accept these terms, sign-up as a Provider and download the Sorted House App. 

  1. Who we are and what this Agreement does
    1. We are Sorted House Ltd of 172-174 Albert Road, Jarrow, Tyne and Wear, NE32 5JA. 
    2. We license you to use the Sorted House Solution, the data supplied with it, any updates or supplements to it and the content we provide to you through it (Services) as permitted in these terms.
    3. As a Provider, you can download and use the Sorted House Solution to identify Users who may wish to purchase your goods/services. 
  2. Sorted House Provider Registration
    1. If you wish to register with us as a Provider, you are required to provide the following information that we may disclose to Users:
      1. full business name;
      2. full business address;
      3. main contact name:
      4. main contact telephone number;
      5. main contact email address;
      6. details of the services you offer;
      7. the locations you cover; and
      8. any other information we may reasonably request.
    2. As part of the registration process, you are required to provide a photograph to form part of your profile. You agree that all photographs submitted by you are acceptable, appropriate and relevant to be used to promote your services. If any explicit or inappropriate photographs are uploaded by you to the Sorted House Solution this will be taken very seriously and we reserve the right to remove or suspend your use of our Service for uploading inappropriate content.
    3. If you do not provide full or accurate information, we reserve the right to reject your application to register for our Services.
  3. Vetting
    1. In addition to the registration information required under clause 2.1, as part of the Provider registration process, Sorted House requires evidence of the following information in order to vet you. Until such evidence is received we will not provide you with access to the Sorted House Solution and you will be unable to begin using our Service:
      1. company incorporation certificate;
      2. VAT registration certificate (or VAT number);
      3. public and/or employee liability insurance;
      4. relevant qualifications and/or experience;
      5. proof of address;
      6. photo identification (passport or driving licence);
      7. a minimum of two references; and
      8. any other information we may reasonably request.
    2. If you do not provide full or accurate information to enable us to vet you, we reserve the right to reject your application to register for our Services.
  4. Matching
    1. The Service works by matching you with potential Users. 
    2. Users are required to provide details of the work or project they would like to be completed (Job).
    3. The User is solely responsible for the accuracy of the information inputted into the Sorted House Solution.  We accept no responsibility for errors, omissions or inaccurate material available through our Services.
  5. How you can use Sorted House
    1. Once a User has requested a quotation for a Job, provided that the Job is in your specified location for the services you provide, we may contact you on their behalf. Our contact with you is based on your ranking (from highest to lowest) and your availability in their area at the dates and/or times indicated by the User.
    2. We will only provide User contact details to you when you confirm that you are interested in the Job and wish to provide a quotation.
    3. When a new Job is created a User can set its preferences to identify if the work is urgent or not.
    4. If a job is not urgent:
      1. a notification is sent to the top-rated Provider in the User’s location who is able to provide services to match that particular Job. The contracted Provider has a set time period within which to accept a Job (Allocated Time Frame);
      2. if that Provider does not respond within the Allotted Time Frame, the Job is sent to the second top-rated Provider in the location.  This process continues unless and until a Provider accepts the Job;
      3. if you accept a Job, outside your Allotted Time Frame, your acceptance will only be actioned if the Providers whose current Allocated Time Frame is active rejects the Job or does not reply.
    5. Where a User marks a job as urgent, a notice is sent to all Providers within the User’s specified location that are deemed over the minimum acceptable standard for ratings. 
    6. Users can use the Sorted House Solution to obtain multiple quotes for the same Job from different Providers. We do not guarantee exclusivity of jobs.
    7. You can choose how you would like to be notified in the settings and notifications section of your profile page.
    8. It is your responsibility to decide whether to accept a Job from a User and to undertake the checks you deem necessary (if any) before agreeing to complete the Job for the User.
    9. Sorted House do not vet Users and accept no liability or responsibility for their actions or the accuracy of the information provided by the User in the description of the Job.
    10. If you engage with a User, you must negotiate the terms and conditions for completion of that Job (including confirming price) with the User.   We are not a party to this contract and merely provide the matching service to put customers and suppliers in direct contact.  We are not, therefore, liable for any loss or damage, costs or claims that may arise between Users and Providers.
  6. Payments
    1. Sorted House charge Providers an agreed rate per Job. Rates are notified to Providers on registration for our Service dependant on the type of work offered.
    2. We reserve the right to increase our rates and will notify you of such increase by email. All new rates are immediately applicable for new Jobs offered and accepted after notice of any increase. If you do not accept the new rate, you cannot continue to use the Sorted House Solution.
    3. All payments are due to us when the Job is marked as completed, and in any event within 14 days of completion. You are required to keep your list of active Jobs up to date and must update this each time you login. We reserve the right to request evidence of completion of any Job at any time. If we notice your activity is not regularly being updated or suspect that you are avoiding payment by not updating your active Jobs list, we reserve the right to refuse to notify you of new Jobs or terminate your use of our Services.
    4. We accept payment by debit and credit card only.  Where payments are made by credit card and an unjustified chargeback is made in relation to our fees, then you are liable to pay us, within 7 days following our written request:
      1. an amount equal to the amount of the chargeback;
      2. all third party expenses incurred by us in relation to the charge back (including charges made by our bank or your bank);
      3. an administration fee of £25 including VAT
      4. all our reasonable costs, losses and expenses incurred in recovering the amounts referred to in clause 6 (including without limitation legal fees and debt collection fees).
    5. For the avoidance of doubt, if you make a chargeback as a result of failing to recognise or remember the source of an entry on your credit card statement, this will constitute an unjustified chargeback for the purposes of this clause 6.
    6. If you fail to make any payments due to us under these terms, then you shall pay interest on the overdue amount at 4% per annum above the base rate of the Bank of England. This interest will accrue on a daily basis from the due date until the date of payment of the overdue amount whether before or after judgement.
  7. Refunds
    1. If a User requests a total refund for a Job, our refund policy is that you will also receive a full refund of the agreed fee paid by you to Sorted House provided you discuss the issue with us prior to refunding a User and evidence refunds to us by providing such documentation as we may reasonably request.
    2. This clause 7 applies to total refunds only.  Sorted House reserve the right to request evidence of such payment to a User, along with copy quotations and invoices before processing your refund.
    3. For the avoidance of doubt, a full refund constitutes 100% of the total invoice for the Job requested by the User.
    4. We reserve the right to suspend or terminate your use of the Services if you make a refund and this may impact your ranking.
  8. Ranking
    1. We rank all Providers based on feedback we receive from Users.
    2. We do not recommend or endorse the work of any Provider and Users are asked to independently assess a Providers suitability to perform any Job.  We are not responsible for the feedback provided by any User and will not provide this to you.
    3. For all new Providers where User feedback has not yet been received, we take account of references and existing public information.
    4. We reserve the right to suspend your activity or terminate your use of the Services if your rating falls below the minimum standard as a result of persistent negative User feedback.
  9. Your privacy
    1. We only use any personal data we collect through your use of the Sorted House Solution and the Services in the ways set out in our privacy policy, available at www.sortedhouse.com
    2. Please be aware that internet transmissions are never completely private or secure and that any message or information you send using the Sorted House Solution or any Service may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
  10. Appstore’s terms also apply

    The ways in which you can use the Sorted House Solution may also be controlled by the appstore rules and policies from which you downloaded the Sorted House Solution (including Google Play and Apple’s Appstore). Your appstore’s rules and policies will apply instead of these terms where there are differences between the two.

  11. Sorted House Solution requirements

    The Sorted House Solution may require a mobile device with a minimum of amount of memory and certain operating systems to function correctly (Sorted House Solution Requirements). The Sorted House Solution Requirements will be outlined on www.sortedhouse.com (Website) and/or your Sorted House store’s details of Sorted House which you can view before you download the Sorted House Solution or at any time. As and when we update the Sorted House Solution we may also update the Sorted House Solution Requirements so you should regularly review those. We are not responsible for any problems you may face with the Sorted House Solution if you do not use a device which meets the Sorted House Solution requirements.

  12. Support for the Sorted House Solution and how to tell us about technical problems
    1. Support

      If you want to learn more about the Sorted House Solution or the Services or have any problems using them please take a look at the support pages of our Websites, email info@sortedhouse.com or contact us by telephone (telephone number will be displayed on www.sortedhouse.com).

    2. Contacting us (including with technical complaints)

      If you think the Sorted House Solution or the Services are faulty or misdescribed or wish to contact us for any other reason linked to performance of the Sorted House App please email our customer service team at info@sortedhouse.com or by telephone (telephone number will be displayed on www.sortedhouse.com).

    3. How we will communicate with you

      If we have to contact you we will do so by email, by SMS or by pre-paid post, using the contact details you have provided to us.

    4. How you may use the Sorted House Solution, including how many devices you may use it on

      In return for your agreeing to comply with these terms you may:

      1. view, use and display the Sorted House Solution and the Services; and
      2. receive and use any free supplementary software code or update of the Sorted House Solution incorporating “patches” and corrections of errors as we may provide to you.
    5. You may not transfer the Sorted House Solution to someone else

      We are giving you personally the right to use the Sorted House Solution and the Services as set out above.  You may not otherwise transfer the Sorted House Solution or the Services to someone else, whether for money, for anything else or for free. If you sell any device on which the Sorted House Solution is installed, you must remove the Sorted House Solution from it.

  13. Changes to these Terms

    We may need to change these terms to reflect changes in law or best practice or to deal with additional features which we introduce.  We will give you at least 30 days’ notice of any change by sending you an email with details of the change or notifying you of a change when you next start the Sorted House Solution. 

  14. Update to the Sorted House Solution and Changes to the Service

    From time to time we may automatically update the Sorted House Solution and change the Service to improve performance, enhance functionality, reflect changes to the operating system or address security issues. Alternatively we may ask you to update the Sorted House Solution for these reasons.

    If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using the Sorted House Solution and the Services.

  15. If someone else owns the phone or device you are using

    If you download or stream the Sorted House Solution onto any phone or other device not owned by you, you must have the owner’s permission to do so. You will be responsible for complying with these terms, whether or not you own the phone or other device.

  16. We may collect technical data about your device

    By using the Sorted House Solution or any of the Services, you agree to us collecting and using technical information about the devices you use the Sorted House Solution on and related software, hardware and peripherals to improve our products and to provide any Services to you.

  17. We may collect location data (but you can turn location services off)

    We will make use of location data sent from your devices. You can turn off this functionality at any time by turning off the location services settings for the Sorted House Solution on the device. You consent to our transmission, collection, retention, maintenance, processing and use of your location data and queries to provide and improve location-based and road traffic-based products and services.

    You may stop us collecting such data at any time by turning off the location services settings on your device.

  18. We are not responsible for other websites you link to
    1. The Sorted House Solution or any Service may contain links to other independent websites which are not provided by us. Such independent sites are not under our control, and we are not responsible for and have not checked and approved their content or their privacy policies (if any).
    2. You will need to make your own independent judgement about whether to use any such independent sites, including whether to buy any products or services offered by them.
  19. Licence restrictions

    You agree that you will:

    1. not rent, lease, sub-license, loan, provide, or otherwise make available, the Sorted House Solution or the Services in any form, in whole or in part to any person without prior written consent from us;
    2. not copy the Sorted House Solution or Services, except as part of the normal use of the Sorted House Solution or where it is necessary for the purpose of back-up or operational security;
    3. not translate, merge, adapt, vary, alter or modify, the whole or any part of the Sorted House Solution or our Services nor permit the Sorted House Solution or the Services or any part of them to be combined with, or become incorporated in, any other programs, except as necessary to use the Sorted House Solution and the Services on devices as permitted in these terms;
    4. not disassemble, de-compile, reverse engineer or create derivative works based on the whole or any part of the Sorted House Solution or the Services nor attempt to do any such things, except to the extent that (by virtue of sections 50B and 296A of the Copyright, Designs and Patents Act 1988) such actions cannot be prohibited because they are necessary to decompile the Sorted House Solution to obtain the information necessary to create an independent program that can be operated with the Sorted House Solution or with another program (Permitted Objective), and provided that the information obtained by you during such activities:
      1. is not disclosed or communicated without the Licensor’s prior written consent to any third party to whom it is not necessary to disclose or communicate it in order to achieve the Permitted Objective;
      2. is not used to create any software that is substantially similar in its expression to the Sorted House Solution;
      3. is kept secure; and
      4. is used only for the Permitted Objective,
    5. comply with all applicable technology control or export laws and regulations that apply to the technology used or supported by Sorted House or any Service.
  20. Acceptable use restrictions

    You must:

    1. not use the Sorted House Solution or any Service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the Sorted House Solution, any Service or any operating system;
    2. not infringe our intellectual property rights or those of any third party in relation to your use of the Sorted House Solution or any Service (to the extent that such use is not licensed by these terms);
    3. not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the Sorted House Solution or any Service;
    4. not use the Sorted House Solution or any Service in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and
    5. not collect or harvest any information or data from any Service or our systems or attempt to decipher any transmissions to or from the servers running any Service.
  21. Intellectual Property Rights

    All intellectual property rights in the Sorted House Solution and the Services throughout the world belong to us (or our licensors) and the rights in the Sorted House Solution and the Services are licensed (not sold) to you. You have no intellectual property rights in, or to, the Sorted House Solution, or the Services other than the right to use them in accordance with these terms.

  22. Our responsibility for loss of damage suffered by you
    1. We are responsible to you for foreseeable loss and damage caused by us

      If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accepted these terms, both we and you knew it might happen.

    2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so

      This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.

    3. When we are liable for damage to your property

      If defective digital content that we have supplied damages a device or digital content belonging to you, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.

    4. We are not liable for business losses

      We will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

    5. Limitations to the Sorted House Solution and the services

      The Sorted House Solution and the Services are provided for general information purposes only. They do not offer advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of information obtained from the Sorted House Solution or the Service. Although we make reasonable efforts to update the information provided by the Sorted House Solution and the Service, we make no representations, warranties or guarantees, whether express or implied, that such information is accurate, complete or up to date.  If you are dissatisfied with the Sorted House Solution or the Services your sole and exclusive remedy shall be to discontinue use of the Sorted House Solution and the Services.

    6. Check that the Sorted House Solution and the services are suitable for you

      The Sorted House Solution and the Services have not been developed to meet your individual requirements. Please check that the facilities and functions of the Sorted House Solution and the Services (as described on appstore site) meet your requirements.

    7. We are not responsible for events outside our control

      If our provision of the Services or support for the Sorted House Solution or the Services is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event but if there is a risk of substantial delay you may contact us to end your contract with us and receive a refund for any Services you have paid for but not received.

    8. We may end your rights to use the Sorted House Solution and the services if you break these terms

      We may end your rights to use the Sorted House Solution and Services at any time by contacting you if you have broken these terms in a serious way. If what you have done can be put right we will give you a reasonable opportunity to do so.

  23. Assignment and transfers

    We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.  You may only transfer your rights or your obligations under these terms to another person if we agree in writing.

  24. No rights for third parties

    This Agreement does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement.

  25. If a court finds part of this contract illegal the rest will continue in force

    Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

  26. Waiver

    Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

  27. Governing Law and Jurisdiction

    These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
